Terms of sale

This English text is a translation provided for information. The French version is the only legally binding one, and this contract is governed by French law.
These Terms of sale govern purchases of credits offered by the modilogo service, published by Nabil Aïnas under the business name Aineed (SIRET 895 166 502 00024), hereinafter “the Publisher”. modilogo offers no subscription: the only possible purchase is a credit pack, paid once, with no renewal.
1. Customer's capacity
Any purchase assumes that the Customer has the legal capacity to contract. By making a purchase, the Customer declares that they are of full age, or that they are a minor acting with the prior permission of their legal guardian, who then stands as guarantor for payment.
Using the service without purchasing remains open from the age of 15, under the conditions set out in the Terms of use. Only the purchase of credits is subject to this clause.
Where a purchase was made by a minor without that permission, their legal guardian may request its cancellation by writing to contact@modilogo.com. Unused credits are then cancelled and the corresponding payment refunded, without the time limit set out in section 7 being applicable.
2. What is sold
modilogo runs on credits. Credits are used to generate and iterate on logos with AI, and to unlock the export (retrieval of every format) of a project. Editing by hand is free. Free credits are granted on registration so the service can be tried out.
Credits are bought as one-off packs:
- “To try it” pack — 100 credits for €10.
- “Most common” pack — 250 credits for €22.
- “Best value” pack — 600 credits for €50.
A welcome bonus may double the credits of a first purchase. Free and purchased credits are pooled into a single balance attached to the account. The number of credits, the prices and the cost per action may change; the schedule in force is the one displayed in the service at the time of purchase.
3. Prices and payment methods
Prices are stated in euros, and are charged in euros regardless of the Customer's country: any currency conversion is carried out by the Customer's bank, at its own rate. As the Publisher falls under the French VAT exemption scheme, the statement “VAT not applicable, article 293 B of the CGI” applies. Payments are processed by Stripe Payments Europe Ltd. (Ireland). The Publisher neither stores nor handles card details.
4. Invoicing
- Each credit pack purchase is a single payment, with no renewal and no recurring charge.
- Credits are added to the account balance immediately after the payment is confirmed.
- An invoice is issued automatically by Stripe for each purchase and remains available to the Customer.
5. Validity of credits
Credits have no expiry date for as long as the account remains active. They are lost if the account is deleted. Credits have no monetary value, are neither transferable nor exchangeable, and cannot be refunded in cash.
6. Promotional codes
Promotional codes may be offered occasionally (for example at launch, or for referrals). They can be used under the conditions and for the period stated at the time of payment, and cannot be combined with one another unless stated otherwise.
7. Right of withdrawal
Credits are digital content whose supply begins as soon as they are added to the account balance. Under the EU Consumer Rights Directive (2011/83/EU), transposed in France at article L.221-28 1° and 13° of the Code de la consommation, the right of withdrawal cannot be exercised once supply has begun with the Customer's prior express consent and express acknowledgement of the loss of that right.
By proceeding to payment, the Customer expressly requests that the credits be made available immediately and acknowledges that they waive their 14-day right of withdrawal as soon as one credit from the purchased pack has been used. For as long as no credit from a purchase has been used, the Customer may request cancellation of that purchase within 14 days at contact@modilogo.com.
Where the Customer is a consumer resident outside the European Union, this section does not deprive them of any mandatory right granted by the law of their country of residence.
8. Refunds
Credit packs are not refundable once at least one credit from the pack has been used. In the event of a proven error attributable to the service (for example a charge with no corresponding generation), the credits concerned are automatically refunded to the balance; failing that, the Customer may report it to contact@modilogo.com and the request will be reviewed case by case.
9. Changes to offers and prices
The Publisher reserves the right to change its packs, cost per action and prices. Such changes have no effect on credits already acquired, which remain usable under the rules in force when they were purchased.

11. Disputes
Consumers resident in the European Union may use the European online dispute resolution platform ec.europa.eu/consumers/odr. Failing an amicable resolution, the French courts have sole jurisdiction, without depriving a consumer of the protection afforded by the mandatory rules of the law of their country of residence.
