Terms of use

This English text is a translation provided for information. The French version is the only legally binding one, and this contract is governed by French law.
These Terms of use (the “Terms”) govern access to and use of the modilogo service, published by Nabil Aïnas under the business name Aineed (SIRET 895 166 502 00024), hereinafter “the Publisher”. Using the service implies full and unreserved acceptance of these Terms.
1. Purpose of the service
modilogo is an AI-assisted logo creation tool. From a description, the service generates logo proposals, then breaks them apart into editable objects (shapes, text, colours) that the User can change by hand before exporting them (SVG, PNG, PDF, favicons).
2. Registration and user account
- Creating an account is required. Authentication is delegated to Clerk (email + password, Google, or any other provider offered).
- The User warrants that the information provided is accurate and undertakes to keep it up to date.
- Account sign-in is the User's sole responsibility. Any access made with their credentials is presumed to be their own.
- The User must be at least 15 years old, or have the permission of a legal guardian.
3. User content
The User remains the owner of their content (prompts, uploaded images, generated shapes and logos). By uploading or generating it through the service, they grant the Publisher a non-exclusive, royalty-free licence strictly limited to operating the service (storage, display, transmission to the generation models).
The User undertakes not to upload or generate:
- Content that is unlawful, defamatory, hateful, that constitutes child sexual abuse material, or that incites violence or discrimination.
- Content that infringes the rights of others (copyright, registered trade marks, image rights, privacy). In particular, the User must not reproduce a protected mark or logo without permission.
- Content intended to circumvent the technical limitations of the underlying AI models.
The Publisher reserves the right to suspend or delete, without notice, any account or content that breaches these Terms.
4. AI image generation
Generations are produced by third-party artificial intelligence models (Google Gemini at the time of writing). The Publisher warrants neither the quality, nor the originality, nor the absence of similarity with existing logos or trade marks. The User is solely responsible for the use they make of the generated logos and must check their availability and legal compliance (in particular that no earlier trade mark is infringed) before any commercial use or registration.
5. Credits and usage limits
The service runs on a credit system, with no subscription. On registration, a balance of free credits is granted so the service can be tried out. Each AI generation or iteration consumes credits; unlocking the export of a logo (retrieving every format for a project) also consumes credits. Editing by hand (moving, recolouring, retyping a shape) is free, because it calls no AI model.
Costs and credit packs are detailed in the service and in the Terms of sale. The Publisher reserves the right to change costs, quotas and features at any time, with reasonable notice sent by email to the users concerned. Manifestly abnormal, abusive or automated use (multiple accounts, scripts) may result in suspension of the account.
6. Availability
The Publisher takes reasonable steps to keep the service available, without warranting 24/7 continuity. Interruptions may occur for maintenance, technical incidents or causes beyond its control (third-party provider outage, network failure, and so on).
7. Liability
To the extent permitted by law, the Publisher's liability is limited to the amount actually paid by the User over the last 12 months. The Publisher cannot be held liable for indirect damage, loss of data, or commercial loss arising from use or unavailability of the service.
8. Deletion and termination
The User may delete their account at any time from the account management interface (Clerk). Deletion erases their projects, logos and associated preferences. Any remaining credits are lost and give rise to no refund. Billing records are kept for the statutory period (see the Terms of sale and the Privacy policy).
The Publisher may terminate an account in the event of a serious or repeated breach of these Terms, with prior notice except in an emergency.
9. Governing law and jurisdiction
These Terms are governed by French law. Any dispute not resolved amicably falls within the exclusive jurisdiction of the French courts. Where the User is a consumer resident in another country, this does not deprive them of the protection afforded by the mandatory rules of the law of their country of residence.
10. Changes
These Terms may be changed at any time. The version in force is the one available on this page on the date of the action concerned. Substantial changes will be notified by email with at least 30 days' notice.
